
In the afterglow of another fabulous @Paris Arbitration Week, I ask myself: what is noise and what is core, in the quest for apex dispute lawyers to deliver an apex service to clients? One can be lulled into a sense, amid flowing champagne and bubbly conversations, that we are not just the hegemons of excellence but that we will also remain at the zenith of relevance for years to come. HOWEVER: we should not be caught napping:
I am reminded by my multiple conversations with listed company General Counsel that, as one put it, “law firms sell to us an excellent tumour removal service, but what we really want is good health and the absence of tumours”. In other words, disputes are a risk asset with sometimes all downside that most companies are best off without.
Bright lawyers love complex problems. How do we know? Count how many law firms have a practice group dedicated to “complex disputes”. BUT AGAIN: by the time the discussion becomes how procedurally complex for example AI and code related disputes are, we should promptly step up the discussion to the next level and ask: is a quick resolution not better than multi-year proceedings? And how to get there smartly, cost-effectively and quickly?
